1. Agreement to these terms
These Terms of Use govern your access to and use of the Kitti iOS app and this website. Kitti is developed and operated by Bryl Lim in the Philippines. By downloading, accessing, or using Kitti, you agree to these terms and the Privacy Policy. If you do not agree, do not use Kitti.
2. Eligibility
You must be legally capable of entering into this agreement where you live. Kitti is not directed to children under 13. If you are a minor, you may use Kitti only with the permission and supervision of a parent or legal guardian who accepts these terms on your behalf.
3. What Kitti provides
Kitti helps you create personalized learning roadmaps, read generated lessons, answer quizzes, schedule focus sessions, review progress, and interact with a virtual companion. Some features require an internet connection and access to Apple, iCloud, Firebase, or Google Gemini services. Sign in with Apple and iCloud sync are optional.
Kitti may add, change, limit, suspend, or remove features when needed to improve the app, maintain security, comply with law, or respond to service-provider changes.
4. Kitti Pro subscriptions
Pomodoro, focus history and statistics, focus notifications, account, privacy, and data controls are available without a subscription. Kitti Pro unlocks personalized learning roadmaps, generated lessons, quizzes, reviews, fish and feeding features, and companion customization.
Kitti Pro is offered as a monthly or yearly auto-renewable subscription through Apple's App Store. The price and billing period shown in the purchase screen are the terms that apply in your App Store region. There is no free trial. Payment is charged to your Apple Account when you confirm the purchase, and the subscription renews automatically for the same period unless you turn off auto-renewal before renewal.
You can manage or cancel Kitti Pro in your Apple Account subscription settings. Cancellation stops future renewal but does not remove access before the end of the paid period or any billing-grace access reported by Apple. Apple handles billing and refunds under its applicable terms. Deleting Kitti or a Kitti profile does not cancel an App Store subscription. Restore Purchases can recover eligible access without a Kitti account.
5. Personal-use license
Subject to these terms, you receive a limited, non-exclusive, non-transferable, revocable license to use Kitti for your personal, non-commercial learning. This license does not transfer ownership of Kitti or any app assets to you.
6. Your learning requests and content
You keep any rights you have in the learning topics, goals, and other content you submit. You give Kitti and its service providers permission to process that content only as needed to operate, secure, and improve the requested app features and comply with law.
You are responsible for ensuring that your submissions are lawful and that you have permission to use them. Do not submit confidential, highly sensitive, infringing, deceptive, or harmful content.
7. AI-generated content
Kitti uses generative AI to create roadmaps, lessons, quizzes, and explanations. AI output can be incomplete, inaccurate, outdated, biased, or unsuitable for your situation. It may also resemble material generated for other people. You are responsible for reviewing and verifying important information before relying on it.
Kitti is an educational tool, not a substitute for a qualified teacher or for medical, legal, financial, safety, or other professional advice. For high-stakes or rapidly changing topics, consult authoritative sources and an appropriate professional.
8. Acceptable use
You must not use Kitti to:
- Break the law or violate another person’s rights.
- Generate or distribute material that meaningfully facilitates harm, abuse, fraud, exploitation, or dangerous wrongdoing.
- Interfere with the app, bypass security or usage limits, probe for vulnerabilities, or access systems without authorization.
- Reverse engineer, copy, resell, sublicense, or commercially exploit Kitti except where applicable law expressly permits it.
- Misrepresent AI-generated output as verified professional advice or use it to make automated decisions about another person’s rights.
9. Accounts, sync, subscriptions, and deletion
If you use Sign in with Apple, you are responsible for protecting your Apple account and device. Optional CloudKit sync depends on your iCloud account and Apple’s services. You can sign out or use Kitti’s deletion controls at any time. Deleting the app may remove local data but does not cancel Kitti Pro or necessarily remove information retained by Apple, Google, or RevenueCat under their own terms and legal obligations.
10. Third-party services
Kitti depends on services provided by Apple, Google, and RevenueCat. RevenueCat processes App Store purchase and entitlement information for Kitti Pro using an anonymous purchase identifier that is separate from optional Sign in with Apple. Your use of those services may also be governed by their terms and privacy policies. I do not control and am not responsible for third-party availability, infrastructure, content, or independent data practices.
11. Intellectual property
Kitti’s software, visual design, mascot, animations, branding, and original app content are owned by Bryl Lim or used under license and are protected by intellectual-property laws. “Kitti” and associated visual elements may not be used in a way that suggests endorsement or affiliation without written permission.
12. Availability and changes
Kitti is provided subject to network availability, service quotas, platform requirements, maintenance, and third-party dependencies. The app may occasionally be unavailable or fail to generate content. I do not promise that every feature will always be available, error-free, secure, or compatible with every device or operating-system version.
13. Disclaimers
To the fullest extent permitted by law, Kitti is provided “as is” and “as available,” without express or implied warranties, including warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, or uninterrupted availability. Nothing in these terms excludes a warranty or right that cannot lawfully be excluded.
14. Limitation of liability
To the fullest extent permitted by law, Bryl Lim will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, learning progress, profits, opportunities, or goodwill arising from Kitti or AI-generated content. Any total liability for claims relating to Kitti will not exceed the amount you paid for Kitti during the twelve months before the event giving rise to the claim. These limits do not apply where prohibited by law or to liability that cannot lawfully be limited.
15. Suspension and termination
You may stop using Kitti at any time. Access may be suspended or terminated if you materially violate these terms, misuse the service, create security or legal risk, or if operating the service is no longer practical. Provisions that by their nature should survive termination, including intellectual property, disclaimers, liability limits, and governing law, will continue to apply.
16. Governing law
These terms are governed by the laws of the Republic of the Philippines, without regard to conflict-of-law rules. Courts with jurisdiction in the Philippines will have authority over disputes, except where consumer-protection law in your location requires a different forum or gives you additional rights.
17. Changes to these terms
These terms may be updated when Kitti’s features, providers, or legal obligations change. The effective date will be updated. Continuing to use Kitti after revised terms take effect means you accept them to the extent permitted by law.
